Legal and fiscal support
Art Market Regulations: Monitoring and Information
The Committee carries out a scrupulous sectoral watch of the evolution of art trade regulations, which allows it to inform its members with regularity and precision on all the specificities of their status, their duties and obligations. Example: practical information sheet in the framework of the TRACFIN regulations. This support on technical subjects inherent to the gallery or antique dealer professions is achieved in particular by sending a monthly newsletter and organizing breakfasts with the intervention of experts.
Code Of Ethics for Art Galleries: Reference Tool
This code aims to recall the rights and obligations of art galleries and dealers. It outlines the professional relationship with artists and an artist’s beneficiaries; presents the relationship with buyers or sellers; but also the relationship between colleagues. The elements set out relate to the applicable legislation, jurisprudence and regulations. They are also based on recognized professional practices, while respecting the interests of each party. The code of ethics for art galleries enhances and secures the profession of gallery owner and its professional environment.
Model Gallerist – Artist / Rightsholder Contracts: Technical Tools available to members.
Attentive to the difficulties that can arise during collaborations between an artist / rightsholder and an art gallery and mainly at the time of their separation, the CPGA has drafted a model representation mandate that relies on many years of feedback, and the expertise of specialized lawyers from each of the two parties.
Peer Mediation: Guarantor of Compliance with Ethical Rules
While the Committee does not intervene in any way in the relationships between artists/rights holders and gallery owners or between collectors and gallery owners, it may however be called upon to play an advisory or even a mediating role in finding solutions to problems encountered between professionals.
Adapted Legal and Tax Advice
Attentive to the requests of its members, the CPGA provides personalized advice on technical, legal and tax matters.
Rapid issuance upon request of import VAT bond exemptions for temporary admissions: as a representative professional organization, the CPGA acts as a guarantor for its members and thus guarantees the seriousness of the movement of works of art under temporary importation into France.
